Assured Shorthold Tenancies
These can be ended by means of a Section 8 notice for rent arrears or by a Section 21 notice to end the tenancy. The latter is cheaper and does not require a hearing. The former is longer, always needs a hearing but can be a help in obtaining the Court's consent for transfer. In addition a money judgement for arrears can be added to the Order.
Issue and Service of Notice
The Bailiff Company can assist in the completion and personal service of such notices. That way you can be assured that one company can complete the work from start to finish. It can also be used as evidence to assist the application for transfer up.
County Court Bailiff or HCEO
Once you have your Order for Possession, you have to decide whether to use the County Court Bailiffs under a warrant of execution or an HCEO under a writ. County Court Bailiffs have a waiting list of several weeks and then have a slow and set procedure to go through. An HCEO can often act within 48 hours.
Transferring a County Court Order for Possession
You can apply to transfer your order for possession to the High Court for enforcement by a High Court Enforcement Officer (Sheriff) under a writ of possession.
The Bailiff Company will provide all the necessary documentation, correctly completed with all relevant information included.to make an application for transfer. We will lead you and assist you through the whole process.
It should be noted by landlords that District Judges have discretion as to whether they should allow such applications. Whilst we will assist in every way we cannot give a guarantee that every application will be allowed.
